PLAINTIFF in error, hereinafter referred to as defendant, was convicted of the larceny, in Denver, of an auto truck and contents and sentenced to a term of from four to six years in the penitentiary. To review that judgment he prosecutes this writ and asks that it be made a supersedeas. The cause has been finally submitted and orally argued. The twenty-one assignments are presented under ten divisions: (1) The transfer of the cause from one division of the court to another; (2) the selection of the jury; (3) the sufficiency of the evidence; (4) the refusal of the court to compel the prosecutor to elect; (5) the refusal to give certain requested instructions; (6) the refusal to direct a verdict; (7) the submission of the second court; (8) the giving of instruction 13; (9) improper conduct of the district attorney; (10) the form of the sentence.
